Prosecutors are scheduled to reveal the grand jury's outcome on Friday in Manhattan Supreme Court.

McIntosh will to spend his third afternoon on the witness stand tomorrow, telling grand jurors that he beat the two women with the handle of a metal grill-scraper out of self defense after they vaulted the counter and came at him, said his lawyer, Theodore Herlich.

McIntosh believed they were about to use deadly physical force, given that both were screaming that they were going to "cut" him after an argument over whether a $50 bill was real or fake, Herlich said.

Meanwhile, the lawyer for the two women acknowledged that it may well have been "inappropriate" for them to jump the counter. But nothing excuses McIntosh beating both women so hard, said their lawyer, Harold Baker. The woman most seriously injured, Denise Darbeau, was on the floor as McIntosh continued to swing at her.

Darbeau, 24, of Queens, nearly died of her injuries, which included a depressed fracture to her skull and a fracture in her humerus, the bone between the shoulder and elbow, the lawyer said. She still suffers short term memory loss, he said.
